Terms and Conditions

1. Who you are contracting with

BigLobster is the trading name under which Francisco Brais Nieto Romero carries on business, as an independent professional (a natural person) tax resident in Thailand. It is not a registered company.

2. Subject matter

These terms govern the purchase of BigLobster's automation subscriptions: software agents that carry out recurring tasks on the customer's website and content, hosted and operated by BigLobster.

What you are buying is access to software running continuously, not an allocation of human working hours. The scope of each subscription is the one set out on the corresponding agent's entry on the pricing page, which forms an integral part of this contract.

Use of the website implies acceptance of these terms. Purchasing a subscription additionally requires express acceptance during sign-up.

3. What each subscription includes

Unless the product entry states otherwise, every subscription includes:

It does not include AI model consumption. The subscription price does not include the consumption of AI models: you need your own API key from OpenRouter, or from whichever model provider you prefer, and you pay that consumption directly to that provider. BigLobster neither resells nor intermediates that consumption, and is not answerable for that provider's price changes, quota limits or outages, in accordance with clause 12. The API key is configured securely during sign-up and the customer may revoke it at any time.

It also does not include bespoke development, migrations, specific integrations or consultancy. That work is contracted and invoiced separately, outside the shop, and forms no part of any subscription.

4. Sign-up and activation

The subscription is concluded once payment for the first period is completed and BigLobster confirms sign-up by email. Activation in under 24 business hours from subscription confirmation.

To be able to run the service, the customer must provide the minimum technical access indicated at sign-up. If it is not provided, the subscription may be suspended, with no right to a refund of periods already consumed, after notice by email.

BigLobster also carries out bespoke development and integration projects. That work is not sold through the shop or the checkout: it is quoted, contracted and invoiced independently and directly between the parties, under its own specific terms. Nothing set out in these terms for subscriptions applies to it automatically.

9. Intellectual property

The website's content (text, design, code, images) belongs to BigLobster or its licensors. Reproduction without express written authorisation is prohibited.

The outputs generated by the agents for the customer (articles, infographics, reports and configurations applied to their systems) belong to the customer from the moment of delivery. BigLobster retains ownership of the software, the agents and the infrastructure that produces them.

10. Artificial intelligence

Delivery of the service is automated and carried out by artificial intelligence systems with human oversight of decisions. The applicable transparency terms are set out in Use of artificial intelligence, which forms part of these terms.

11. Availability and support commitment

The service is provided with the reasonable diligence of a professional in the field. BigLobster does not commit to an availability percentage (uptime): at the published prices we could not measure or compensate one seriously, and we prefer not to promise what we cannot sustain.

What we do commit to is support: a response within 24 business hours at soporte@biglobster.top for any incident, sign-up, cancellation or refund request. If an incident prevents an agent from running for an extended period, compensation in service time is agreed with the customer.

Nor is any particular commercial outcome guaranteed: the agents perform the agreed work; they do not guarantee sales, search rankings or any specific metrics.

12. Third-party dependencies

The service relies on external providers that BigLobster does not control, principally artificial intelligence model providers, third-party APIs and hosting providers. The following are excluded from the committed availability and from BigLobster's liability:

If one of these circumstances prevents the service from being provided on a lasting basis, BigLobster will notify the customer and may replace the affected provider or, where that is not feasible, terminate the subscription and refund the unused proportion.

Save for wilful misconduct or gross negligence, and without prejudice to any mandatory rights the customer has as a consumer:

14. Data protection and processing agreement

The processing of personal data is governed by the Privacy Policy, drafted in accordance with Regulation (EU) 2016/679 (GDPR), which distinguishes BigLobster's two roles: controller in respect of its own subscribers' data, and processor in respect of the data its agents handle on the customer's behalf.

On purchasing a subscription, the parties additionally enter into a data processing agreement under Article 28 GDPR, which is incorporated into these terms and prevails over them as to its subject matter. In that relationship the customer is the controller and BigLobster acts solely on their documented instructions. You may request a copy before purchasing at soporte@biglobster.top.

15. Governing law and disputes

These terms are governed by the law of Thailand, the place of residence of the business owner, and the parties submit to its competent courts.

This clause does not deprive the customer of the protection afforded by the mandatory provisions of the country of their habitual residence. If you are contracting as a consumer resident in the European Union, you retain in full the rights granted to you by the consumer legislation of your country, including the ability to bring proceedings before the courts of your domicile, and you may use the European online dispute resolution platform.

16. Changes

BigLobster may amend these terms. The version in force is always the one published on this page, identified by the version date in the header and recorded in the version history.

Material changes affecting active subscriptions will be communicated by email 30 days in advance, under the same advance notice of change regime as clause 6. As there, that period is advance notice and bears no relation to the 30-day refund window in clause 5.
